U.S. Customs and Border Protection (CBP) has developed a new electronic refund process, the ACE Portal, which is set to be effective February 6, 2026. For importers that pay customs duties and tariffs, this will be the new mechanism to retrieve any potential refunds or drawbacks that the business may be eligible for.

This portal is of particular importance as it relates to the International Emergency Economic Powers Act (IEEPA) Tariff cases before the Supreme Court which put the constitutionality of the tariffs on the docket.  If the Court rules against the President, there will be a potential for refunds on the tariffs paid, which would be distributed through the ACE portal.
